1. Introduction
1.1. Welcome to Iustitia. We provide professional writing and immigration advisory services tailored to the South African immigration industry. We are not a professional law firm and do not offer legal services exclusively reserved for registered legal practitioners under South African law.
1.2. Our services include providing limited immigration advice, preparing documents, and conducting follow-ups relating to immigration status, appeals, or applications.
1.3. By engaging our services, you agree to be bound by these Terms of Service.
2. No Guarantee of Outcome
2.1. The Department of Home Affairs (“DHA”) retains sole decision-making authority in all immigration matters. We cannot guarantee the success of any appeal or application we prepare on your behalf. We are not liable for any rejected appeals or applications.
2.2. We cannot commence work until quoted fees have been paid in full and all requested information has been provided.
2.3. Refunds may be provided in full or in part at our discretion, with deductions for work already commenced or completed.
3. Client Obligations
3.1. You warrant that all information you provide to us is true, correct, and accurate. We are not liable for any consequences resulting from incorrect information provided by you or on your behalf.
3.2. We may request additional information at any time, and you agree to cooperate in providing it.
4. Intellectual Property
4.1. All documents, letters, and written materials prepared by Iustitia remain our intellectual property at all times. We grant you a limited, non-exclusive right to use such materials solely for the specific immigration purpose for which they were prepared — including submitting them to the DHA or relevant authority in the form in which they are provided to you. You may not edit, reproduce, resell, or repurpose any materials we produce.
4.2. Our intellectual property may not be modified, reproduced, distributed, or used for any purpose other than as described in clause 4.1 without our prior written consent.
5. Payment
5.1. Fees are payable in full before work commences unless otherwise agreed in writing.
5.2. You will be informed of all fees upfront and invoiced before any drafting begins. No additional fees will be charged without your prior approval.
5.3. Overdue amounts may attract interest and recovery costs.
6. Limitation of Liability
6.1. Except in cases of gross negligence, we are not liable for any loss, damage, or injury arising from our services or from decisions made by any government authority.
6.2. We are not liable for any consequential, indirect, or special losses, including loss of profits or opportunity.
7. Contractor Confidentiality
7.1. We cannot disclose the identity of any contractor or service provider engaged to work on your matter, except where required by law or with their express consent.
8. Privacy
8.1. We collect and process your personal information solely for the purpose of rendering our services to you, in accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”). 9. Governing Law
9.1. These Terms are governed by the laws of the Republic of South Africa.
